The XD+ subscription program (“XD+”) provides several benefits to subscribers of the program (“Member”, or “Members”), the details of which are outlined herein (“Terms”), including any limitations and exclusions. These Terms govern the respective rights and obligations of Xpressdocs and/or its affiliates (“Xpressdocs”) to XD+ Members. When signing up for an XD+ membership, you accept the terms, conditions, limitations and requirements outlined herein, along with those detailed in our Privacy Policy.

XD+ Member Benefits

Free Ground Shipping. The XD+ shipping benefit provides Members with free Ground office and free Ground home delivery for products eligible for flat rate shipping, within the United States (excludes international orders). Orders/consolidated carts weighing over 10lbs may be subject to shipping surcharges; these surcharges are not included in the subscription benefits but the base shipping cost will still be waived for subscribers. Product eligibility is not guaranteed, but typically includes print-on-demand products such as business cards, postcards, flyers, brochures, rack cards and door hangers. Shipping benefits are limited to select products and/or quantities, and are at the sole discretion of Xpressdocs. Some special product, order, handling fees, and/or taxes may still apply to eligible purchases. If only select items in an order are eligible for XD+, the Member will pay applicable shipping charges only for the ineligible items. Changing or combining orders, or changing a shipping address, speed, or preferences might affect XD+ free ground shipping eligibility.

Free Business Cards. XD+ Members are eligible to receive free business cards for each year of active membership. Members will be provided a promotional code to utilize when ordering business cards, which will only work on business card products available from the Member’s user account within the Xpressdocs website. Members will receive this promotional code with 1-2 business days of subscribing to XD+. With this promotion, Members will receive up to 250 business cards, with a maximum value of US$32.50; if a Member selects a larger quantity, or business cards with a higher value, the Member will receive a discount of $32.50 off the order. Members will automatically be sent a new promotional code every twelve (12) months, on the date of your original subscription, for as long as they maintain a continuous, active and paid membership in XD+.

Free Targeted Mailing Lists. XD+ Members receive free, single-use geo-targeted mailing lists for each direct mail campaign purchased through their Xpressdocs account. Geo-targeted mailing lists include radius and street targeting, for locations within the United States.

Exclusive Sales Events. XD+ Members shall have access to promotions and sales, provided their subscription is active during the promotion or sale period. Xpressdocs shall determine, at its sole discretion, the offers, discounts, product eligibility, timing, duration, notice period and frequency of each sales event.

Memberships

XPRESSDOCS, AT ITS SOLE DISCRETION, RESERVES THE RIGHT TO ACCEPT OR REFUSE MEMBERSHIP IN THE XD+ PROGRAM. FROM TIME TO TIME, XPRESSDOCS MAY CHOOSE TO ADD OR REMOVE XD+ MEMBERSHIP BENEFITS. SOME XD+ BENEFITS MAY REQUIRE CERTAIN PURCHASE THRESHOLDS, HAVE QUANTITY OR SHIPPING ADDRESS LIMITATIONS, OR REQUIRE MEMBERS TO MEET SPECIFIED CRITERIA IN ORDER TO ACCESS THEM. XPRESSDOCS MAY SEND MEMBERS EMAIL, AND OTHER COMMUNICATIONS RELATED TO XD+ AND THE XD+ MEMBERSHIP WHILE A SUBSCRIPTION IS ACTIVE.

Member Limitations. Members may not transfer or assign their XD+ membership or any XD+ benefits, including promotion codes for XD+ memberships or benefits. XD+ Members are not permitted to purchase products for the purpose of resale, rental, or on behalf of third parties, using XD+ benefits.

Automatic Subscription Renewal. UNLESS A MEMBER CANCELS THEIR XD+ SUBSCRIPTION BEFORE THE END OF THE CURRENT SUBSCRIPTION TERM, THEIR XD+ MEMBERSHIP WILL AUTOMATICALLY CONTINUE, AND WITHOUT NOTICE TO THE MEMBER, XPRESSDOCS SHALL COLLECT THE THEN-APPLICABLE MEMBERSHIP FEE AND ANY TAXES, USING ANY ELIGIBLE PAYMENT METHOD ASSOCIATED WITH THEIR ACCOUNT.

Subscription Payment Failures. If all eligible payment methods Xpressdocs has on file for a Member are declined for payment of their membership fee, the Member must provide Xpressdocs a new eligible payment method within five (5) business days or their membership will be canceled. Members who provide Xpressdocs with a new eligible payment method and are successfully charged, may continue to be an XD+ member, and their benefit period will be based on the original subscription renewal date, and not the date of the successful charge.

Cancellation. Members who signed-up for XD+ membership directly through Xpressdocs, may cancel at any time by accessing their account and adjusting their membership settings. Once canceled, membership and benefits will continue through to the end of the subscription period and will not renew. XD+ memberships (including memberships redeemed through an XD+ gift code or promotional code), and company paid subscriptions, are not refundable.

Promotional Trial and Qualification-Based Memberships. Xpressdocs may offer certain customers various trial or other promotional memberships, which are subject to these Terms except as otherwise stated in the promotional offers. Trial members may choose to cancel at any time; cancellations initiated before the end of the trial period will not be charged a membership fee.

Changes to Terms and Benefits. Xpressdocs may, at our sole discretion, change these Terms, Xpressdocs’ Conditions of Use and Privacy Notice, or any aspect of XD+ membership, without notice to Members. If any change to these terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions.

Individual Subscribers. XD+ is intended for the exclusive use of individual subscribers. Under no circumstances may users utilize this subscription program to place orders on behalf of other users via the Xpressdocs platform. Unauthorized use of XD+, including but not limited to the placement of orders for other users, constitutes a violation of these terms of service and may result in immediate termination of the user’s account and/or legal action. All users are required to respect this provision and use the XD+ subscription program responsibly and in accordance with the terms set forth herein.

Termination by Xpressdocs. Xpressdocs may terminate a Member’s XD+ membership at our sole discretion, and without notice, and will provide the Member with a prorated refund based on the number of full months remaining in the subscription term. However, Xpressdocs will not give any refund for termination related to conduct that we determine to be in violation of these Terms or any applicable law, involves fraud or misuse of the XD+ membership, or is harmful to our interests or another user. Xpressdocs failure to insist upon or enforce a Members strict compliance with these Terms will not constitute a waiver of any of our rights.

Limitation of Liability

XPRESSDOCS TOTAL LIABILITY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WILL NOT EXCEED THE LAST MEMBERSHIP FEE YOU PAID. THIS LIMITATION OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND WILL SURVIVE CANCELLATION OR TERMINATION OF A MEMBERS XD+ MEMBERSHIP.

Disputes. Any dispute or claim relating in any way to these Terms or a Members use of XD+ will be adjudicated in the state or Federal courts in Tarrant County, Texas, and by subscribing to XD+ a Member is consenting to exclusive jurisdiction and venue in these courts. Xpressdocs and Members of XD+ waive any right to a jury trial.
